Terms of Service
Effective date: October 3, 2026
These Terms govern your use of Agent Press Wire (the "Service"), available at https://agentpresswire.dev and its API. The Service is operated by Dylan Caponi, a sole proprietor based in Los Angeles, California ("we", "us"). Contact details are on the About page.
1. Acceptance
You accept these Terms by using the Service, including by sending a paid API request, by completing a card checkout, or by having an automated agent send a paid request on your behalf. A request that carries a valid payment is your binding acceptance of these Terms as they stand at the time of the request. If you do not agree, do not use the Service.
2. What the Service does
- You supply a product or company URL and an announcement. An AI model (Claude, provided by Anthropic) drafts a press release using only the page you supplied and the announcement you provided.
- $1 tier: the release is published on our public newsroom page and we notify search engines of the new page.
- $99 and $299 tiers: the release is submitted to third-party distribution partners for distribution to their network of news sites (500+ sites). The $299 premium tier adds additional outlets made available by those partners, such as AP News and USA Today, subject to their acceptance.
Outlet lists, counts and partners may change. We do not control third-party distribution partners or the sites in their networks.
3. Agents acting for principals
If an AI agent, script or other automated system sends a request, the person or organization on whose behalf it acts (the "principal") is bound by these Terms as the customer. Whoever operates or deploys the agent represents and warrants that they have authority to bind the principal and to spend the funds used for payment. If they lack that authority, the agent operator is personally bound by these Terms and responsible for the request.
4. You are the author and publisher of record
Every release is created and published at the request of, and on behalf of, the announcing party named in it. You, not us, are the author, issuer and publisher of record of the release and are solely responsible for its content. We act only as a drafting tool and a distribution conduit. Releases may be labeled as published at the request of the announcing party.
5. AI drafting: you must review
- Releases are drafted by an AI model from the page and announcement you supply. We do not independently research, fact-check or verify any claim.
- AI output can contain errors, omissions, inaccurate statements or wording you did not intend. You are responsible for reviewing the draft (where a preview is offered) and for everything that is published.
- Releases are published verbatim as generated and accepted. Once a release is distributed to third parties it cannot be recalled, edited or deleted from their sites. Removal from our own newsroom is possible on request at our discretion, but copies elsewhere may remain.
6. Your representations and warranties
For every request, you represent and warrant that:
- you are authorized to speak for the company, brand, product or person that is the subject of the announcement;
- the announcement and the page you supply are true, accurate and not misleading, and the resulting release will not be misleading;
- you own or have the rights to all content, names, trademarks and materials you supply and that will appear in the release;
- the release does not defame anyone, invade anyone's privacy or publicity rights, or infringe any copyright, trademark, trade secret or other right;
- the release complies with all applicable laws, including securities laws (for example, rules on disclosure of material information and on promoting securities), advertising and consumer protection laws, and export and sanctions laws;
- you are at least 18 years old and able to form a binding contract; and
- the funds you use to pay are lawfully yours to spend.
7. Prohibited content
You may not use the Service for releases that involve, among other things: sales or promotion of crypto tokens or coins; gambling; adult content; cannabis; health, medical or cure claims; market-moving financial claims such as acquisitions, mergers, earnings, guidance or ticker symbols; anything illegal, fraudulent, deceptive, hateful or harassing; or impersonation of any person or organization. We may refuse requests that we believe fall into these or similar categories, and we may add categories at any time.
8. Our rights to refuse, remove and report
- We may refuse any request, decline to publish or distribute any release, or remove any release from our newsroom, at any time and for any reason, including suspected fraud, inaccuracy or a complaint.
- Third-party distribution partners run their own editorial review and may reject, edit for format, or delay a release. Their decisions are final and outside our control.
- We may report suspected fraud, securities violations or other unlawful activity to the affected parties, distribution partners, payment providers and law enforcement or regulators, and we will cooperate with lawful requests from them, including by sharing the records described below.
- We may suspend or block any wallet address, IP address, agent or user that we believe has violated these Terms.
9. No guarantee of results
We do not guarantee any media pickup, placement, publication on any particular site, search engine indexing or ranking, traffic, leads, sales or other result. Distribution to a partner network means the release is offered to those sites; each site decides whether and how long to carry it. Delivery timing is not guaranteed.
10. Payments and refunds
- Prices are shown on the Service and in the API. Payment is made in USDC over the x402 protocol on the Base network, or by card through Stripe. You are responsible for network fees and for sending the correct amount to the correct address.
- All payments are final, except as follows:
- If the release fails to generate, you are not charged (or, where payment has already settled, we will refund it).
- For card payments, if a distribution partner rejects the release, we automatically refund the payment for that release.
- For USDC payments, refunds (including where a partner rejects a release) are handled manually, on request through the About page, at our discretion. Refunds are sent to the paying wallet address.
- No refund is owed for releases refused or removed because of a breach of these Terms, or because you are unhappy with the wording of a release that was generated and published as requested.
11. Records we keep
To operate the Service, prevent fraud and meet legal obligations, we keep records of each request, including the paying wallet address and transaction hash (or Stripe payment record), the URL and announcement you supplied, the generated release, any contact email you supplied, your IP address and user agent, and timestamps. 12. Indemnification
You will defend, indemnify and hold harmless the operator and his agents and service providers from and against all claims, losses, damages, liabilities, penalties, costs and expenses (including reasonable attorneys' fees) arising from or related to: any release requested by you or on your behalf; the content you supply; your breach of these Terms or of any representation above; your violation of any law or third-party right; or any agent acting on your behalf.
13. Disclaimer of warranties
The Service and all releases are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that AI output will be accurate or suitable for your purpose.
14. Limitation of liability
To the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or reputation, however caused; and (b) our total liability for any claim relating to a release or to the Service is limited to the fees you paid for the specific release that gave rise to the claim. We are not responsible for the acts or omissions of distribution partners, news sites, search engines, blockchain networks, wallets or payment processors. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
15. Copyright and abuse complaints
If you believe a release on our newsroom infringes your copyright or is unlawful, fraudulent or abusive, contact us through the About page. For copyright notices under the Digital Millennium Copyright Act, include: your contact information; identification of the copyrighted work; the URL of the material; a statement of good-faith belief that the use is not authorized; a statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner; and your physical or electronic signature. We may remove material and notify the requester. We can only remove material from our own newsroom; copies on third-party sites must be addressed with those sites.
16. Changes
We may update these Terms at any time by posting a new version at /terms with a new effective date. The version in effect when you send a request applies to that request.
17. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
18. General
- Severability: if any provision is found unenforceable, it will be enforced to the maximum extent possible and the rest of these Terms remain in effect.
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us about the Service and replace any prior understandings.
- No waiver: our failure to enforce a provision is not a waiver of it.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.
